À l’attention de Monsieur Zakaria Ben Mostapha, président du comité supérieur des droits de l’homme et des libertés fondamentales.

Nous, les familles des prisonniers d’opinion, victimes de la loi anti-terroriste, vous lançons cet appel afin d’intervenir pour lever certaines injustices infligées à nos enfants dans les prisons tunisiennes, qui après avoir été emprisonnés en application d’une loi non-constitutionnelle et inhumaine, la loi du 10 décembre 2003, à cause de leurs intentions et non pour des actes commis, ni même à cause d’intentions nuisibles à l’intérêt de la patrie.

Les Tunisiens ont participé dans le passé à la libération de l’Algérie et n’ont pas été jugés, ils ont combattu dans les guerres palestiniennes (1948 et suivantes) et n’ont pas été jugés. Mais aujourd’hui lorsque quelques jeunes projettent de se porter volontaires et participer à la libération de l’Irak et du peuple irakien arabe et musulman des griffes de l’occupation des croisés américano-sionistes, ils sont jetés en prison selon une loi contraire aux dispositions de la constitution et contraire aux principes fondamentaux des droits humains.

Aujourd’hui ils croupissent dans les prisons, certains condamnés à de lourdes peines, d’autres attendent toujours dans des conditions extrêmes : surpopulation sans pareille et absence des conditions minimales, nourriture impropre, incarcération dans des cellules sans aération et sans accès à la lumière du jour ce qui provoque nombre de maladies dangereuses et chroniques, en plus de la maltraitance exercée par les autorités carcérales et leurs agents sur nos enfants qui subissent des châtiments extrêmes et sont l’objet de provocation continue de la part des agents et de certains condamnés de droit commun dont l’administration se sert dans le but d’amener nos enfants à une réaction similaire. Et quand nos enfants ont protesté contre ces pratiques dans la prison du 9 Avril à Tunis, ils ont été déplacés abusivement vers des prisons éloignées à l’intérieur du territoire tunisien, augmentant ainsi les peines et les souffrances des familles qui comptent parfois 2 ou 3 prisonniers, chacun dans une région différente, avec des jours de visite différents et engendrant ainsi des dépenses supplémentaires en transport et « koffa » inabordables vue la cherté de la vie et l’effondrement du pouvoir d’achat, et sans considération pour l’âge avancé de certains parents.

Pour ces raisons

Nous vous prions de bien vouloir intervenir pour :

   mettre un terme à ces déplacements abusifs et de ramener nos enfants dans les prisons de proximité, en l’occurrence la prison du 9 Avril à Tunis,

   attirer l’attention des autorités compétentes pour faire cesser les provocations continues contre les droits de nos enfants,

   améliorer leurs conditions de détention en leur fournissant nourriture saine et accès aux soins médicaux selon les standards internationalement reconnus dans l’attente de la réparation de la plus grande injustice qui leur est faite en ordonnant leur libération car ils sont des victimes innocentes.

Attention of : Mr. Zakaria Ben Mostapha, president of the high committerr for human rights and fundamental freedoms

We, the families of the prisoners of opinion, victims of the anti-terror law, call upon you in order to intervene and lift the injustice inflicted on our children in the Tunisian prisons, who have been jailed in accordance with a non-constitutional and inhuman law- law of 10 December 2003- because of their “intentions” and not acts, nor even because of intentions harmful to the interest of fatherland.

In the past the Tunisian people participated in the liberation of Algeria without being trialled, fought in Palestinian wars (1948 and following) and were not trialled. But nowadays when some youngsters have the intent to volunteer and participate in the liberation of Iraq and of the Arab and Muslim Iraqi people from the clutches of the occupation of the American-Zionist crusaders, they are thrown in prison according to an illegal law in contradiction with the provisions of the constitution and opposite to the fundamental principles of the human rights.

Today they stagnate in the prisons. Some condemned with heavy sentences. Others still waiting under extreme conditions : unprecedented overpopulation and absence of the minimal conditions ; unsuitable food, imprisonment in cells without ventilation and access to daylight which causes a number of dangerous and chronic diseases. In addition to the ill-treatment exerted by the prison authorities and their agents on our children who are undergoing extreme punishments and are exposed to continuous harassments by the agents and some common law criminals recruited by the administration for the purpose of bringing our children to a similar reaction. But when our children protested against these practices in the prison of April 9 in Tunis, they were abusively displaced to distant prisons inside the Tunisian territory, thus increasing the sorrows and the sufferings of the families which count sometimes 2 or 3 prisoners, each one in a different area, with different days of visit and thus generating additional and unaffordable transport and “koffa” expenditure given the higher prices and collapse of the purchasing power, without consideration for the advanced age of certain parents.

For these reasons

We ask you to agree to intervene in order to :

   put a term to these abusive displacements and bring our children back in the prisons of proximity, namely the prison of April 9 in Tunis,

   draw the attention of the competent authorities to stop the continuous harassment against the rights of our children,

   improve their conditions of detention by providing healthy food and access to the medical care according to internationally recognized standards, while waiting of the repair of the greatest injustice which is made to them by ordering their relaxation because they are innocent victims.
